Wisconsin State Representative Tom Tiffany stated that Attorney General Merrick Garland "should be prosecuted" for "failing to comply with a subpoena" to "protect Joe Biden," and claimed that "this corruption" highlights discrepancies between the Hur transcript and the audiotapes. Tiffany made his statement in a June 14 post on X.

"AG Garland failed to comply with a subpoena all to protect Joe Biden," said Tiffany. "He should be prosecuted. This corruption proves that the Hur transcript does not match the audiotapes."

The House Oversight and Judiciary Committees subpoenaed Attorney General Garland on February 27, 2024, seeking records related to President Biden's handling of classified information during Special Counsel Robert Hur’s investigation. According to the committees, Garland refused to release Biden's interview audio files. On May 16, 2024, Biden asserted executive privilege over the recordings just as contempt resolutions were being considered. The resolution declares Garland in criminal contempt under U.S.C. sections 192 and 194, authorizing the Speaker to take legal action, potentially including civil court, to enforce the subpoena, according to a press release by House Speaker Mike Johnson.

Garland responded through a press release by the U.S. Department of Justice: "Today’s vote disregards the constitutional separation of powers, the Justice Department’s need to protect its investigations and the substantial amount of information we have provided to the Committees." He added, "I will always stand up for this Department, its employees, and its vital mission to defend our democracy."

Tiffany represents Wisconsin's 7th Congressional District and was elected in May 2020 during a special election. With roots in the district, he grew up on a dairy farm near Elmwood, Wisconsin, and holds a degree in agricultural economics from the University of Wisconsin – River Falls. Before Congress, Tiffany served in the Wisconsin State Assembly and State Senate, focusing on tax reduction, job creation, and Second Amendment rights protection.
